subject: Auto Repair Shop Adjacent to Water Gardens
The illegal auto repair shop adjacent to Water Gardens is subject to several State and Federal reporting requirements. I doubt if they are submitting any of the required information.
1. Auto repair shops (and the gate manufacturing facility) use, store and generate many toxic and hazardous and flammable chemicals. This would include solvent, paints, antifreeze, batteries, gasoline, diesel, shop rags, etc. They are required by law to report the Tier II chemicals that are hazardous or flammable. By March 1 every year, they are required to submit their list under law. The public is also given the right to know what is being used, created or stored at the facility.
"Submission of Tier II form is required under Section 312 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA). The purpose of this form is to provide state, tribal, and local officials, and the public with specific information on potential hazards. This includes the locations, as well as the amount, of hazardous chemicals present at facilities during the previous calendar year."

2. Attached is another EPA tool that checks for compliance of Automotive Repair Facilities.
The consolidated screening checklist and guidebook is a tool to help you evaluate compliance at your automotive service and repair shop.

We would like to check for compliance with both of the above criteria. We invoke the "Emergency Planning and Community Right-to-Know Act (EPCRA)". The March 1 reporting date has expired, so the data should be available. Previous years reporting would also be helpful. Any help you can provide would be appreciated.

Hi Steve, I will send you the email we received from Tawni in regards to the gate business. Mr Mosquera who owns the property and operates the gate business stopped by MV last week to inform them he would be relocating his business elsewhere. He even showed them paperwork for the new lease. The rental house whose occupants do the car repair work is right now tied up with the courts, Mr. Mosquera has been trying to get them evicted.
The mayor and council I are to be updated by the attorneys handling the case at the March 25 council meeting at 7:00 pm at the Lake Wilderness location.
I might be bad but I would like to see the city be fined for allowing this to have gone on for so long, since 2007. They knew about this but did nothing until we had had enough and got the mayor involved. The mayor has been great, it’s the people below him that weren’t doing their jobs.
I’ll be back from Arizona on March 20 if you have any questions. I think it’s great with the info you sent to the city informing them of what this company wasn’t doing.
